Please read these Terms and Conditions carefully. They represent the Terms and Conditions between you and Sainsbury’s for the use of the Homemade Food Network Service (“Homemade”).  You are authorised to use Homemade solely on the basis of these Terms and Conditions and on the basis of the Sainsbury’s Terms and Conditions for the Use of Website.  You must accept them and our Privacy Policy if you wish to use it.  If you do not agree, you may not use Homemade.

 

Sainsbury’s reserves the right, at our absolute discretion, to update and/or revise these Terms and Conditions.  We may change them by updating them and posting a notification of the changes on the Homemade site.  Continued use of Homemade will indicate your acceptance of the changes.

1.         Use of the Homemade Food Network Service

 

1.1 By using or registering at Homemade you are authorised to view and download our Website for your personal, non commercial use only.  

 

1.2 You may view the Homemade Food Network or comment using social media without registration but by viewing the site you agree that you will not use Homemade content except for personal, non commercial purposes.  To access, contribute comment or add content to Homemade you must Register

 

1.3 Sainsbury’s may at any time without notice or liability:

 

a) Temporarily restrict access for repairs, standard maintenance or the introduction of new Services: and

b) change, suspend or discontinue the Homemade Food Network; and

c) change the availability of any feature, database, or content; and

d) impose limits on certain features and services; and

e) restrict your access to parts of or the entire Homemade Food Network  

 

1.4 Sainsbury’s cannot guarantee that Homemade will be fault free or that it will meet your requirements.  Please report any faults in the Service to the onsite feedback service or enquiries@homemadebyyou.co.uk.

           

 

2.         Registration and Information Security

 

2.1 To register with Homemade you must be over eighteen years of age and a UK resident. You must ensure that the details provided by you on registration or at any time are correct and complete. You must inform us immediately of any changes to the information that you provided when registering by updating your details in My Account.  You must give us your real name, email address and any other details that we may require to process your membership.

 

2.2 Membership is limited to one membership per person.  Multiple accounts are not permitted. You agree that use of your membership is personal to you.

 

2.3 We reserve the right:

 

a) To decline a new registration or suspend an account at any time

b) To terminate access to all or parts of Homemade without notice

c) To create limits on use and size of scrapbooks

 

2.4 We may check your registration details to ensure they are correct and we may close your account if we suspect or believe that you have deliberately provided incorrect information.

 

2.5 At initial registration we will ask you to choose a password.  You will need to enter this password whenever you sign into Homemade.  You must keep this password confidential and not disclose it to anyone else or write it down.  If you suspect that someone else knows your password or security details, you should change your password and let us know immediately by email to enquiries@homemadebyyou.co.uk.

 

2.6 Following initial registration, we will send you an account activation email.  Please click on the link to complete the registration process. 

 

2.7. Following registration you may access your 'My Account' page which may be accessed whenever you login to Homemade. Your 'My Account' page will show your personal account details and your activity on the Homemade food network.

 

2.8 By providing us with your details and opting in to receive marketing you confirm that you are happy for us to communicate with you by post or email for marketing and market research purposes.

 

3          Pricing

 

3.1      Membership of Homemade is free. 

 

3.2      From time to time we may offer the opportunity to purchase products or services.  We reserve the right to charge for these.

 

 

 

4.         Homemade site Content

 

4.1      Homemade site content may include, but is not restricted to:

 

a) access to features, videos, inspirational articles, recipes; and

b) participation in a food forum with the opportunity to add comments; and

c) recipe ingredient swaps; and

d) the opportunity to create your own scrapbook of food-related content; and

e) access to any Homemade promotional challenges or competitions which may appear on Homemade from time to time.  Separate terms and conditions for any prize promotions may appear on Homemade linked to individual promotions. 

 

  • Standard promotional terms.  Entrants must be UK residents, aged 18 or over.  Employees of Sainsbury’s Supermarkets Ltd and anyone professionally associated with the promotion may not enter.  Entries must be received by the date specified on the promotional page.  Where the promotion includes a prize, the winner will be chosen from all entries received as being the most apt or appropriate response to the challenge and the winner will be announced within 7 days of the stated closing date.  The display name of the winner will be shown on Homemade.  Any prize will be awarded within 28 days.  Where applicable the promoter reserves the right to substitute any prize for one of greater or equal value and there will be no cash alternative.  Only one entry per person.  By entering any promotional challenge, entrants agree that their entry, including any submitted photographs, is their own original work and that they have right, including any necessary permissions to submit it.  Entrants agree to reasonable publicity and that the promoter may use their entry for the purposes outlined in Term 4.4 of these Terms and Conditions.  Promoter: Sainsbury’s Supermarkets Ltd, 33 Holborn, London EC1N 2HT.

 

4.2 From time to time we may invite you to submit your own ideas and recipes via social media or in a Scrapbook linked to your account. You should only provide content that you are comfortable sharing.

 

4.3 By participating or submitting content you confirm that the work is not copied, and is your own original work.  You confirm that you have the right to submit it and that you accept responsibility for it .

 

4.4 By participating or submitting content you agree to grant a worldwide, royalty-free irrevocable licence, including the right to sub-licence, to Sainsbury’s and Homemade to use, publish, adapt, distribute and reproduce the content, including your Scrapbook or any part of it in any marketing, blog, social media, recipe, comment, food product or website in whole or in part without notice or payment.  You agree that Sainsbury’s and Homemade will be free to use your comments, feedback and suggestions for any purpose without limitation including developing and marketing products and services without any liability or payment to you.

 

4.5 You agree that your Scrapbook, comments and ideas may be followed, shared, commented on and incorporated into the Scrapbooks of other members subject to the Member Conduct Rules.

 

4.6 Homemade site content may be amended, substituted, withdrawn or deleted by us at any time and without notice. 

 

4.7 Homemade will update and save your Scrapbook on its server but may change or delete features and content in any way it sees fit at any time and for any reason.  Homemade accepts no responsibility for the loss or corruption of Scrapbook or other content.

 

5. Unsubscribe

 

5.1 You have the right to change your marketing preferences at any time.

 

5.2 Should you wish to change your marketing preferences you may do so at any time by changing your preferences in your ‘My Account’ page marketing permissions. You may receive further marketing material for up to 3 months.

 

6. Nectar

 

6.1 Homemade does not currently offer Nectar points.  If this changes we will update the Homemade site and these Terms and Conditions. 

 

7. E-vouchers and promotions

 

7.1 From time to time, Homemade may issue e-vouchers, money off or additional Nectar point vouchers which may only be used subject to these Terms and Conditions and any other Terms and Conditions linked to the e-voucher.

 

7.2 E-vouchers, money off, or additional Nectar vouchers, are, and remain at all times the property of Sainsbury’s Supermarkets Ltd. The right to use a voucher (including e-vouchers) is personal to the original or named recipient and may not be transferred without permission. It may not be copied, reproduced or published either directly or indirectly. Vouchers distributed or circulated without our prior written approval are not valid and may be refused or cancelled. If you redeem or attempt to redeem a voucher to which you are not entitled you may be committing an offence.

 

7.3 Sainsbury’s reserves the right to cancel or withdraw any voucher or promotion at any time without notice and without reason.

 

7.4 Unless otherwise stated a voucher may be used only by the named recipient, it may only be used as stated on the voucher and not in conjunction with any other offer or voucher. Vouchers cannot be exchanged for cash.

 

8. Links

 

8.1 Homemade may provide links to third party websites or resources. Homemade has no control over such websites and resources and you agree that links to third party websites are provided solely for your convenience and that Sainsbury’s and Homemade are not responsible or liable for the availability or content of these sites. If you decide to click through to any third party websites you do so entirely at your own risk.

 

9. Member conduct

 

9.1 Whilst using Homemade you agree that your use of the site will not be for the following purposes:

  • Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material.
  • Transmitting material that is or which encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
  • Gaining unauthorised access to other computer systems.
  • Interfering with any other person's use or enjoyment of the Website.
  • Breaching any laws concerning the use of public telecommunications networks.
  • Interfering or disrupting networks or websites connected to the Website.
  • Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
  • Engaging in technically harmful behaviour, which includes but is not limited to: computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data and other malicious software or harmful data.

 

9.2 Homemade allows members to comment on Scrapbooks, recipes or other content and may operate member forums, including chat rooms and message boards, allowing members to exchange views, opinions and support.  

 

9.3  You are responsible for your own interaction with other users of Homemade and agree that Homemade may, but is not responsible for monitoring such use.  The rules for comment are:

  • Members should respect each other at all times.
  • The spirit of all posts should be constructive, supportive and of general benefit to the whole community. We reserve the right to remove any comment and our decision is final in these matters.
  • Any messages posted are the views and opinions of members, and do not necessarily reflect those held by Sainsbury’s or Homemade who are not responsible for the accuracy of information posted.
  • We reserve the right to edit or reproduce any of the comments made in the forum, including tips and advice and recipes.

 

9.4  Sainsbury’s and Homemade reserves the right to refuse to post content on Homemade or to remove or edit content already posted on Homemade.

 

9.5 Homemade users and Members accept that Homemade content or Member comments and suggestions may not be suitable for your own purposes and that nutritional and/or other information provided by Members may not necessarily be correct.  You should satisfy yourself that recipe content, nutritional or allergen information is correct and suitable for your own purposes. Sainsbury’s and Homemade may not monitor or review the site and accept no liability for any errors or omissions.

 

10. Privacy

 

10.1  Registration data and certain other information about you is subject to our Privacy Policy, which you should read before you accept these Terms and Conditions.

 

11. Intellectual property

 

11.1  The content of the Homemade website is protected by copyright, trademarks, database and other intellectual property rights. You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from Sainsbury’s.

 

11.2 Homemade respects the intellectual property rights of others and expects our Members to do the same.  If you believe that your Content has been used in a way that infringes your copyright or to report image functionality please contact us at editorial@homemadebyyou.co.uk.

 

12. Limitations

 

12.1 This Website and the Retail Sites and any software are provided on an "AS IS" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.

 

13. Indemnity

 

13.1 You agree to indemnify and hold Sainsbury’s and Homemade harmless from all liabilities, claims and expenses that arise out of the content you submit, post or transmit to Homemade, or from your use/misuse of Homemade.

 

a) You must not use Homemade in any unlawful manner or for any unlawful purpose or attempt to obtain income from the use or provision of the Homemade Service.  Sainsbury’s and Homemade will not be liable to you for any losses suffered or costs incurred because:

b) You are unable to use the Homemade Service for any reason

c) Any content submitted by you is corrupted, damaged, is lost or deleted

d) The Homemade Service fails to work as expected or is defective and we have not corrected any errors including any incompatibility with any internet service used by you

 

13.2 Sainsbury’s and Homemade assumes no liability for any modification, suspension or discontinuance of the Service

 

13.3 Sainsbury’s and Homemade excludes all liability, so far as is permitted by law, including without limitation, direct, indirect or consequential loss or damages or any loss of profits, loss of revenue, business interruption, loss of data or otherwise.

 

13.4 Our liability for losses you suffer as a result of us breaching this Agreement is strictly limited to the purchase price of any products or services you purchase from us.

 

This does not include or limit in any way our liability:

 

a) For death or personal injury caused by our negligence

b) Under section 2(3) of the Consumer Protection Act 1987

c) For fraud or fraudulent misrepresentation; or

d) For any matter for which it would be illegal for us to exclude, or attempt to exclude our liability.

 

14. Events outside our control

 

14.1    Sainsbury’s and Homemade will not be liable for or responsible for any failure to perform or delay in performance that is caused by events outside our reasonable control (Force Majeure event).

 

 

15. Miscellaneous

 

a) If we fail, at any time, to insist upon strict performance of any of your obligations or any of these terms and conditions, or if we fail to exercise any of the rights and remedies to which we are entitled to, this shall not constitute a waiver or such rights or remedies and shall not relieve you from compliance with such obligations.

 

b) A waiver by us of any default shall not constitute a waiver of any subsequent default.

 

15.3    If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable.

 

15.4    This Agreement shall be governed by and construed in accordance with the laws of England and the parties submit to the non-exclusive jurisdiction of the English Courts.
